A woman who says she slept on orange peel fires a fruit suit for $1 million. The elderly woman is suing a mall and a produce farm after she says she fell a badly hurt herself. Eyewitness News is live with the latest on this story for you, Dennis. Well, Sally, it's the kind of story that almost sounds like a joke, but Bertha Haden says her injuries are anything but funny. It was too much for me to go through. I just don't want to think about it before. Hayden doesn't like to talk about that day in December of 1996. That's when the 76 year old woman and her family were Christmas shopping at Westminster's Cranberry Mall. They decided to taste a sample from Bulger's fruit stand while they were walking over. She spent four months in a cast. Neighbors say the fall transformed an active friend who liked to clean the street in front of her house into a fearful recluse who was reluctant to come outside. She can barely walk. She has to use a cane or whatever it is with those bangs on the bottom. Hayden's attorney tells Eyewitness News he filed this lawsuit when he couldn't reach an agreement with the insurance company for bloggers and the mall. He says his client has more than $70,000 in medical bills. Hayden's suing Cranberry Mall and the fruit stand for $500,000 each. The suit alleges they are liable because food debris on the floor created a hazard. A spokesperson for the mall says its management hasn't seen the lawsuit and can't comment. Bertha is letting her attorney and friend do most of the talking. Some people look at this and say she's suing over the falling on an orange peel and they kind of laughed. No, that's not funny. If they would be in the same situation, they would think it over. Different thing when you're on the other end. Yes, definitely. The owner of the produce fund that owns the stand tells Eyewitness News the food on the floor was left there by a customer who did not properly dispose of the peeling. The mall is waiting to see the suit before responding. Hayden's attorneys say they're suing for $1 million because she now has the need for long term medical care. Sally. Dennis, thank you. A horrifying day for another elderly person. A man, an East Point mall is carjacked and thrown into a trunk. There was no money taken and no one was harmed. Investigators say an elderly man's daily trip to the mall turned into a terrifying trip through the unknown to unknown locations for unknown reasons. Again, this is there's no motive involved that we know of. He did not ask for money, did not demand anything other than the fact that they put him in the trunk and stole his car. It began at 415 Monday afternoon, East Point Mall. Londo just outside Value City Furniture. This is where 79 year old William Moore exited an East Point mall and headed toward his car. But when he arrived here, he found someone was waiting. He was approached by a black male who pushed him against his vehicle, took keys from him, then forced him into the trunk of his car while he was pushing him into the trunk of the car, he struck him once in the face and locked him in his trunk. He never said anything to him. He then took off in the vehicle. I don't know where he went. Two hours later, investigators say someone discovered the elderly man's car. At 6:00, Baltimore City receives a call stating that there's a suspicious vehicle that they can hear somebody yelling in the back of the trunk. It was William Moore. Shaken but safe. Meanwhile, at this point, mall administrators say security is heightened. As always. Eyewitness News has tips to keep you safe when you shop at your favorite stores. A shootout at a menswear store in East Baltimore sends the store owner to shock trauma today. The shootout started when the owner was ringing up a supposed customer. Police tell Eyewitness News the suspect reportedly pulled a gun from his waistband, at which point the store owner pulled a gun from behind the counter. Several shots were exchanged and the store owner took a bullet in the arm. The gunman ran away. He's still at large and police do not know whether he's injured. The store owners injury is not thought to be serious either. County man is being treated at Johns Hopkins Bayview tonight after a complicated incident in Dundalk. Police say they were called to this house on Leslie Road for a possible overdose and barricade. Shortly after they arrived, they saw the house was on fire. Officers say they managed to get the man out. Firefighters did get the fire under control in about an hour, but the house was still destroyed. The victim suffered minor smoke inhalation and may have overdosed on antidepressants. Fear of a dangerous chemical leak forces an evacuation in southwest Baltimore early this morning. It happened around 7:30 a.m. in the industrial park on Washington Boulevard. Someone at the Woodstock company thought they saw ammonia leaking from a truck. Police were called and they evacuated the building and called hazmat crews to the scene. They tell Eyewitness News that construction is taking place in the science labs and letters have been sent home notifying parents and students of an asbestos abatement. I'm not going to sit up in a school that is going to affect me in the future when I'm trying to get an education. It's not right to anybody. And there's children out there, kids that are fighting right here and kids up there because they're afraid of what's going to happen to their babies. A school spokesman says Eyewitness News that no asbestos has yet been removed and all reported health concerns will be investigated. Help is on the way for Marylanders who are still cleaning up debris and mopping up water after Hurricane Floyd swept through our state almost two weeks ago. The Federal Emergency Management Agency, FEMA, announced today that funds are now available for people who suffered from Floyd's fury. Now, a normal rainfall to this date would be 30.65in at the same. In a downtown. They're there almost to the normal for the whole year, 39.22in of rainfall. Amazing amount of rainfall this year. Most of it. The bulk of that ten inches or more far during the month of September. Well, we're about two inches shy of the absolute highest record rainfall for September. We're going to see more rainfall tonight, especially tomorrow afternoon. It's possible some areas could get up to two inches of rain between now and Thursday. If the airport gets it, then we'll go over the record. This be the wettest September in historical records. And tonight's Out in the News How to watch. Parkinson's is a neurological disorder in which nerve cells degenerate and the part of the brain that controls body movements. The classic signs are tremors, limb stiffness, balance problems and general slowness of movement. Fox told members of Congress that he's shocked and frustrated by the meager funding that goes towards finding a cure for Parkinson's. For many people with Parkinson's, managing their disease is a full time job. It is a constant balancing act. Too little medicine causes tremors and stiffness, too much medicine, produces uncontrollable movement and slurring. And far too often, Parkinson's patients wait in wait, as I am right now, for the medicines to kick in. I'm an expert in only one what it is like to be a young man, husband and father with Parkinson's disease. With the help of daily medication and selective exertion, I can still perform my job, in my case, in a very public area. I can still help out with the daily tasks and rituals involved in home life. But I don't kid myself. That will change. Physical and mental exhaustion will become more and more of a factor, as will increased rigidity, tremor and dyskinesia. I can expect in my 40s to face challenges most won't expect until the 70s or 80s, if ever. But with your help, if we all do everything we can to eradicate this disease, in my 50s, I'll be dancing at my children's weddings. And you may have noticed the way he was swaying. That's a result of Parkinson's. I know. Well, you know, my mom had it. It was very brave of him to go public like that. Our researchers making any headway that you can tell us about? You may remember the search and rescue group was sent by the government to Turkey when a different killer earthquake devastated that area. I just don't feel like a lot of these folks do that it would be the detriment to the lighthouse. I think it would enhance the lighthouse. But opponents are signing petitions. Some are joining Lucille in her crusade. Others say wait and see. Everybody has a right to build whatever on their property as long as it goes with the city ordinance. Kai, this morning, Sister Gramlich was at the White House for a meeting of religious leaders and she tells Eyewitness News she's been ministering to gays and lesbians for more than 20 years, but says that church politics are what's bringing this center stage after all this time in the eyes of Sister Janine Granik. They are all God's children. Initially, when they came to an awareness of their same sex orientation, felt that the church did not care for them, did not love them, did not want them, so they abandoned their the religion of their youth. She is an author, a nun who's obeying the church's order, but it won't quell her quest for change. Do you see this as a defeat? It's certainly a defeat in the sense of like, putting an impediment in the way of the ministry that I feel called by God to do. But I want to turn, I guess, that defeat around in the catechism. The church clearly does not condone homosexual acts, but says that gays and lesbians, quote, must be accepted with respect, compassion and sensitivity. Something Sister Gramlich thought she was doing. But the church apparently didn't think she went far enough. I was telling the people that if they engage in homosexual activity according to the church, that is not right. That is wrong. Okay. What did they want you to say? Well, Maryland gun dealers say they'll be out of business if the governor has his way. Governor Glendening has appointed a task force to draft legislation requiring all guns sold in Maryland be equipped with safety technology that's still being developed. Valid gun owner Sanford Abrams testified before the task force yesterday. Eyewitness News went to his Hartford Road Gun shop where he told that Warren dealers should be allowed to continue to sell other guns in addition to the new ones we're talking about. If the technology comes out, we'll sell it. Apples going into dumplings and pies may actually be sweeter this year because heat and dry weather have a way of intensifying a fruit's natural sugar. In our pies we add sugar to make them sweet and guarantee their sweet. But it seems like we don't need that as much this year after the dry summer. I certainly am. The question of shopper safety after a carjacking at a local mall to the eyes of a mall employee. Hello, everyone. I'm Vic Carter. And I'm Denise Cole. Here's what people are talking about tonight. An orderly man is carjacked and stuffed into the trunk of his car. A frightening ordeal at a shopping mall. It could have happened to any one of us. Shopping at a mall, falling victim to a man who steals a car and takes you along for the ride. It happened at East Point Mall. The victim, an elderly Baltimore City man who recovers tonight at his home. Eyewitness news is live in East point with the story. And you can McGehee, you can to Vic, you could call it a carjacking, but the car was carjacked or taken only temporarily, in fact. That's why officers are simply baffled about this case, because no one was injured, no one was harmed, no money was stolen in the car, was never taken. Investigators say an elderly man's daily trip to the mall turned into a terrifying trip through the unknown to unknown locations for unknown reasons. Again, this is there's no motive involved that we know of. He was approached by a black male who pushed him against his vehicle, took keys from him and forced him into the trunk of his car While he was pushing him into the trunk of the car, he struck him once in the face and locked him in his trunk. He never said anything to him. He then took off in the vehicle. I don't know where he went. Two hours later, investigators say someone discovered the elderly man's car. At 6:00, Baltimore City receives a call stating that there's a suspicious vehicle, that they can hear somebody yelling in the back of the trunk. It was William Moore, shaken but safe. Meanwhile, at this point, mall administrators say security is heightened. As always. Officers are on 24 hour patrol and security monitors are being surveillance for some clue as to why this happened, who did it and where he could be. William Moore was taken to the hospital yesterday, but only for procedural purposes. His injuries were non-life threatening. He only had bumps and bruises. Rick. Thank you. You can download his news. Well, the mother of a 12 year old boy remains at her son's bedside more than a week after he was shot in the head in Hamden, even though he cannot squeeze her hand and may not even know she's there. Suzanne Collins says the vigil is constant. Police are still unsure who shot Nick Deronda. No one's been arrested, but the boy's mother says she's not worried about an arrest. Right now. She's more focused on the boy who remains in grave condition at Johns Hopkins Pediatric Trauma unit. They said there might be the tiniest shred of hope. A shred of hope. It may take a miracle. Yeah, I have to have. This smiling faces no longer smiling. 12 year old Nick Girondins is not even conscious. He's comatose. I pray every day. Anybody? I mean, I ask them to pray for my son. He's got family in Crete praying for him. Donna Reed leads me outside Johns Hopkins to show photos of her son. Pictures of the boy's memorable trip to Greece a year ago. His father is Greek and was deported not long after meeting Diana in Baltimore. The boy met his grandmother there for the first time and his grandfather, his grandmother here in Baltimore cannot believe he now lies lifeless. Pure pain. I'd like. Nick and his mother only recently moved to this apartment in Woodbury with his grandmother. That's because they had to vacate a place in Glen Burnie, and Donna found she didn't have any money for an additional security deposit, and she didn't want to go to a homeless shelter. But she worried about Nick, saying he didn't have street smarts like some city boys. I feel guilty that I brought him to Baltimore. I felt guilty that I couldn't find him. I feel guilty that I didn't wait for him and that I could have protected the problems of the family. Our many financial hardship makes it hard to buy a meal in the hospital cafeteria. Donna's neck is swollen with Reuters from untreated thyroid disease and a lack of health insurance. But nothing seems so tragic, so insurmountable as the boy's condition. I just don't want my son to die. And I don't want him to be severely brain damaged. The northern district police major says he met with him and residents last night to listen to their concerns. He plans to crack down on the juvenile curfew. It all happened in the wake of Nick Girondins shooting and the murder of another boy recently. Suzanne Collins, thank you. The only guns he wants sold in Maryland are the kind that can only be fired by the person who owns them. The problem is no such gun exists yet. It's the topic of a heated debate. And Pat Warren joins us now live with a look at both sides of this issue Pat. Well, Vic, a governor's task force is studying the matter right now. It's about something called a smart gun, a gun that electronically or magnetically identifies the people who are authorized to use it. Otherwise, the gun won't fire. Now, the technology is still in the developmental stages, and the governor thinks this law could jumpstart that development. But gun dealer Sanford Abrams says the governor is jumping the gun. I would have preferred him to say find out what's the best way we can. We can safeguard our children from accidental discharges. Look at everything. But he said specifically, no trigger locks, no cable locks, no lock boxes, no safes, no barrier methods. He wants electronic fancy. Do that. The Beretta manufacturer says smart gun prototypes have not been proven to work more effectively than existing safety devices. Abrams, who is vice president of the Licensed Firearms Dealers Association, also testified before the governor's task force. This is what we've been telling. We've been telling the people I told them yesterday, I tried to show it to them. They really couldn't care less for the cable lock. What a cable lock does. Which is better than a trigger lock, is that it prevents the final from actually even being loaded. Now, there's no way to load that gun, much less fire it. Abrams says gun dealers are also sensitive to safety issues, but they object to the governor's shotgun approach. And they say shooting down anything that isn't new isn't smart. If this technology works and it comes in the marketplace, we will sell it. We will want to sell it. We just don't want the government telling us we have to have it on every single gun and it won't fit. It won't work. Once again, the governor is proposing that the only guns that are sold in Maryland are smart guns. Now, no one from the governor's office was available to talk to us today, but the task force will continue to meet and Eyewitness News will continue to track its progress. Vic? Okay. Thank you, Pat. The car manufacturing company has been conducting research and development on smart guns and will testify at a later hearing. Well, some students at Southwestern High say they're afraid of school, but it has nothing to do with studies. Instead, they blame asbestos, which making them sick. Eyewitnesses live at the school where my crew has that story. He is playing isn't the only thing around here that's off key. We have a system they care about and people are getting sick from it. Also on the steps of the police district, dozen kids who say that their high school has made them sick from fumes. And that's Bastos. And I got sick yesterday and I went to I was complaining and the teacher saw us open all the windows up because it smelled so it was like, we're real bad. Indeed, the windows are open in this air conditioned school. And this letter says asbestos removal will be taking place. They have a petition going to close the school until the asbestos is gone. We have 54 people who of the administrators here sent home a letter to the parents and the students telling them about the asbestos removal, saying that all demolition would begin at 4:00 in the afternoon once the building is clear. But students I talked to say that that demolition begins much earlier in the day and the workers come in and out. And there's this one area that separates the students from the work that they're doing. And they keep on walking in and out the doors and in half the doors bringing their stuff during school. You can see the workers carrying the tools. You can see them. I mean, you can see them all dirty and dusty from where they've been working. The suit alleges they are liable because fruit debris on the floor created a hazard. A spokesperson for the mall says its management hasn't seen the lawsuit and can't comment. Bertha is letting her attorney and friend do most of the talking. Some people look at this and say she's suing over the falling on an orange peel and they kind of laughed. No, that's not funny. Now, both his attorneys say they're asking for a total of $1 million because she now has need of long term medical care.
