Former NAACP director Ben Chavis is in a Washington, D.C., courtroom trying to get his old job back in to stop the civil rights organization from appointing a replacement. It was this past Saturday at the NAACP board fire chambers. But now, he says, the board violated its own constitution in the way it let him go. And he wants an injunction to block his firing. But according to some of you, it might be better if he just went quietly away again. I don't think you should just let it go. There's too much controversy now. Just let it go. Just let it go. Let it all settle down. Let things just go. I think he's creating more controversy by just fighting it. You know, I think if you just drop back, forgot about it. I think the old NAACP would be better for it, because I think right now, everybody's majority of them seem like they're angry at him for what he did, whether it's true or false, you know? So I think he should move on and make a better ground for himself somewhere else, you know? I think it'd be better off. He seems to have a lot of supporters. Well, he might have supporters, is true, but, sometimes it's better to move on. That's the way I feel. You know? That's my opinion. And, sometimes you got better, you know? One door closes, another one opens. The NAACP board has already appointed an interim director, Earl Shin holster. The hearing in D.C. Superior Court was scheduled again within the past hour. When the crane hit a power line and sent a shock through him, the worker suffered a severe burn to his hand. His condition is being evaluated as we speak. An emotional murder trial returns to a Baltimore County courtroom today because of a technicality. Two years ago, Robert Lipinski was sentenced to life in prison for the murder of 22 year old Gina Cortez. Lipinski was convicted of stabbing her to death at the 2000 Nutrisystem Weight Loss Center. But now the Court of Appeals has ordered a new trial because the law has changed regarding sentencing for first degree murder cases. Another murder trial is set to begin today, this one in Carroll County. Jason DeLong and Sara Santorelli are charged with the stabbing death of his mother and her boyfriend last summer. So Tony has already pleaded guilty of the crime. DeLong has pleaded not guilty by reason of insanity. The manslaughter trial of an Ellicott City accountant accused in the death of his girlfriend continues today in Howard County. Prosecutors say 51 year old Melvin Bowers gave Geneva Hodge a lethal dose of chloroform to treat a toothache last September. His defense lawyers say her death was an accident. Bowers faces a maximum sentence of 15 years in prison if convicted. The battle over evidence in the OJ Simpson murder case continues today in a Los Angeles courtroom. The judge will consider whether Simpson's defense team can have some of the samples from the crime scene. It is evidence the prosecution says, places OJ Simpson at the murder scene in a case in which there's no murder weapon. And as far as we know, no eyewitness took and place Mr. Simpson at the murder scene. The prosecution's case will rest or fall on the strength of its forensic evidence. Two blood drops found leading from the murder scene to the back of Nicole Simpson's townhouse. Genetically matched O.J. Simpson's blood, according to the prosecution. That statement is based on results of DNA testing conducted by so Mark Labs in Maryland. In a preemptive strike on Friday, the defense tried to cast doubt on the reliability of those tests. In a letter to the court, Robert Shapiro accused the prosecution of mislabeling, cutting and switching blood samples. The prosecution harshly criticized Shapiro for releasing the letter to the media in filing letters in this manner, without allowing the people to respond. That means that they can insult has been publicly apologized in private, Your Honor. Judge Lance Kudo said he shared the prosecution's concern, but decided to take the matter up with the rival attorneys behind closed doors, not in open court. Throughout this case, Judge Ito and the attorneys have stressed the need to find an impartial jury. The chances of that may be even less now that the public has information that suggests a link between O.J. Simpson and the Trail of Blood. Karla Davis, ABC news, Los Angeles. Jury selection in OJ's case, is expected to begin September the 19th. The bullet grazed his head. He then managed to drive himself to San Andreas Hospital, where he was treated and released. A new judge will preside over former Baltimore City Comptroller Jacqueline McLean's McLean's next court appearance. The judge, who was handling McLean's theft and misconduct case, removed himself from any further connection with it. Judge Joseph McCurdy said he wanted to avoid the appearance. Politics were influencing the case in any way. But Curtis decision comes after a storm of criticism erupted over a meeting he held with some city council members to discuss that case. In a ruling handed down yesterday by another judge this month at the federal level, it said Baltimore City's ban on aggressive panhandling is unconstitutional. U.S. District Court Judge Fredericks smoking said the ordinance interferes with panhandlers rights of free expression. But those who helped craft the legislation say they plan to try again. The high tech equipment will be tied into a 24 hour a day communications network. When the cameras and radar detect traffic tie ups, they'll be able to warn motorists of them by radio and give them an alternative route. Also in today's consumer watch, the next time you book a flight on Southwest Airlines, you may never get your tickets in the mail or have to pick them up. That's because the airline is going ticket free. CNN Sony Event Cycle Reports. Welcome back from little Rock. It's a common sight at the southwest. Check in counter, exchanging tickets for plastic colored boarding passes. Some are ready to for about 132 Amarillo, but trading your ticket for a boarding card could become a thing of the past a ticketless system. The principle is similar to renting a car a customer. All of the ticket agent or reservation is placing the order over the phone with a credit card instead of a ticket, the customer gets a confirmation number with which to check in. And if all you need to do is have a six digit confirmation code, that's probably the way we think we can go. The test is very limited right now. Only customers going from Dallas to Little Rock, Arkansas or Houston to Corpus Christi can take advantage of the ticketless system, which begins in two weeks. Current southwest customers think it might catch on. You know, when you stop and think about the paper chase, I think, you know, any of the airlines might be interested in looking at a package like that. A ticketless system isn't new. Some charter airlines have it, as did Morris Air, which southwest bought. But a major airline offering such a convenience might very well start a trend in the industry. I think it'd be great. We don't have to fool with keeping up with that. Even if the plan goes system wide, which officials say could take place as early as October, customers will still have the option to get a paper ticket if they prefer. Doctor Benjamin Chavis alleges the NAACP wrongfully fired him. During last weekend's turbulent meeting with the civil rights groups board of directors. So his attorneys went to court today. Ron Mattes was there and joins us now with the latest. Well, I was quite a seeing the hearing held in D.C. Superior Court, where Doctor Chavis was trying to block the civil rights organization from dismissing him. Attorneys for Doctor Chavis are seeking a temporary restraining order, saying the NAACP violated his rights by firing him. The organization says its action was both legal and proper as he arrived outside D.C. Superior Court today. Doctor Chavis was mobbed by the media inside. His attorney A.B. Attorneys for the organization say restoring Chavis to office could hurt its fundraising efforts. Chambers declined comment after today's hearing. But on Nightline last night, he said he wasn't being treated fairly. When I asked several board members about just just treat me fairly, I was told this is not about fairness. This is not about justice. This is about politics. This is about the direction of the NAACP. But NAACP attorneys say its board acted legally and properly in dismissing Chavis three days ago. The board felt that they had sufficient facts to render the decision that it did. They they acted on an educated and informed basis, and they acted, for the in the best interest of the NAACP. And now a judge, Herbert Dixon, is expected to make his decision at 10:00 tomorrow morning. If we can get around some of the legal wrangling, what are the specifics of this case? What are the basics? Well, I think what it comes down to is Doctor Chavis. Stan Saunders joins us with a live report on the closing of the Chavis summit stand. Dev, the summit just concluded about ten, 15 minutes ago, members of the second National African-American Leadership Summit announced that it was a resounding success. They've been meeting here in Baltimore the past three days, and they vowed today to never again let anyone outside of the African-American community dictate or decide for them what they should do. Now, the members of the second summit consisted of more than 100 black leaders representing national, regional and local organizations, preachers, politicians, lawyers and quite a high level entourage surrounding Doctor Chavis. The summit, by the way, not sanctioned by Tavis, his former employer, the NAACP. Of course, that was the case earlier this year when they met also in Baltimore. Now, today, several strategies announced by the summit that will hopefully improve the quality of life for African-Americans in this country. And that's when I ask Doctor Chavis if this makes this leadership summit a direct competitor of the NAACP, a member of the national board of directors of the Is on the interim coordinating committee. That's not competition. That's cooperation. Yeah, we have unity. Of course, I'll have to make some, changes and work on that a little bit. That brought about a little bit of a chuckle, but he seems to be relaxed and comfortable as the new man, as the convener, as he's been named in this national leadership summit to help improve the quality of life for African Americans in America. A legal twist is proving painful for a Baltimore County family because of a technicality. They are being forced to relive the brutal murder of 22 year old Gina Courthouse. Alex Demetric was in court today where the man convicted of killing Cortez is on trial once again for the family of Gina Cortez. The nightmare has returned. He's worried about a job to be killed by this animal. This guy. He killed, this girl I stabbed 13 times. He's like, ha ha. Gina Cortez was 22 years old. In June 1991, she was murdered at work, stabbed to death at a Nutrisystem outlet in Towson. Within a few days of that murder, police connected a bloody footprint with a janitor who later confessed he had killed a young woman in a fit of rage. In 1992, Robert Lipinski was found guilty of first degree murder, but he was back in court standing trial again today because the Court of Appeals ruled that at the time of his sentence, the rules between first and second degree murder had become blurred by new law dealing with the nature of premeditation. A jury is hearing his case this time, and his lawyer is trying to convince them that the killing is a second degree murder, not a first, because it was not premeditated. Jury selection began today in a Carroll County murder trial involving two teenagers, 19 year old Jason DeLong and 17 year old Sarah Citron are charged as adults with the stabbing deaths of his mother and her boyfriend last summer, synchrony pleaded guilty to the killings. DeLong pleaded not guilty by reason of insanity. Three major international drug dealers were brought to justice here in Maryland today. A Manka, John Okpala and Henry and Rosalynn Solomon were extradited from Nigeria by drug enforcement officials. Investigators allege that they have brought over 40 kilos of pure heroin into Baltimore. That means the city must pay the state the difference. The state of Maryland bases its school funding on enrollment figures. The problem apparently stems from a new computer system. After getting her calmed down and talking to her, I explained her procedures, how to attempt to revive her daughter. And she's very calm. Very calm. Just like 9111 television. While talking with Sergeant Douglas on the phone, Luanne and her cousin were able to get crystal breathing. And when paramedics arrived, they took the child to Franklin Square Hospital. Doctors there told Luanne her daughter had had a seizure. They sent Krystal home after a few hours. And today all is well. Luanne is deeply grateful for Sergeant Douglas's help. Oh, I'm just glad because she is the most precious thing I have. I think she was, very thankful. And I was thankful that I could be of some assistance. Do you feel like a hero? No, I don't. I just feel like, basically, I was, just doing my job, just trying to do the very best I'm capable of. Give me sugar cane. And one day, after sheer terror, Luanne is just thrilled to have a happy ending. Sergeant Douglas is a 19 year veteran of the state police. And police still have no clue as to her whereabouts. As Suzanne Collins reports, police are stepping up their efforts, distributing posters and offering a reward. I was wondering if I'd be able to put this in the window. We're looking for Miss Susan Hurley. Harrison. Yes. 18 days have passed, and police are desperate to locate Susan Hurley Harrison. Or at least to find her green Saab convertible, which could lead to her. Two sons have also handed out fliers, and they fret as the day comes to head back to college. I mean, obviously, I don't want to think the worst. I mean, like, I want to keep telling myself that, oh, yeah. Hurley was last seen at her estranged husband's house on August 5th. He says he heard her car pull out of the driveway at 10 p.m.. Three people are shot after a friendly fire incident in Manhattan's subway. Several commuters reported a man with a gun on a jam packed Midtown subway platform. An off duty city officer, an undercover transit officer and a bystander were all shot. One of the officers is in critical condition. The others were not seriously injured, but they saw arrested two teens in the case and investigation is now underway. The Cuban exodus continues despite stern warnings from the U.S. today, Coast guard officials picked up 2200 more Cuban refugees already this month. An estimated 8800 refugees have fled to the U.S.. However, new policy U.S. policy states that refugees picked up at sea will be detained at the U.S. military base on Guantanamo Bay. Right now, the State Department is working on an agreement to have six Western Hemisphere countries accept the refugees. The problem is that a new engine actually cost $4,700, leaving Britain about 800 in the hole. So I said, you know what's going on here? So they they said they were going to prorate the engine. And I said, what? I mean, I caught me off guard. I was like, wait a minute now, did you know that this is going to cost me $1,000 to get my car out of the shop? For their mistake? The insurance company argued that a new, rather than rebuilt engine was put in Britain's car, so he was now actually better off. And he should pay for that. Usually that argument is absolutely correct. The person is entitled to be no better off after the accident than he was before the accident. They did not submit any appraisals, didn't let me know how much it was going to cost that debt. As we indicated here, this this was a very honest mistake. I mean, you know, these kind of things happen when when you have these kind of services done. And actually. Mr.. Mr. tire, not the insurance. Okay. But Mr. Tire worked very hard to like, try to get him the rental car for an extra period of time and other things. His complaint was not with them. His complaint was really with the insurance company to get what he thought he was entitled to. Right now, what happens if you cannot get a rebuilt engine for your car? Well, if you couldn't get a rebuilt energy, the only thing were available were brand new engine. Then the insurance company would have to reimburse you for that because there is no alternative. In other words, there's not a cheaper alternative out there. So in that case, that would be another example where you could get a new engine. You're better off that way. Yeah, sure. Thanks, Dick. The nightteam's Greg started is here with the latest on the suit filed by Jarvis today against the civil rights group. Well, a spokesman for Chavis says tonight they are hoping for a victory in court tomorrow. Tomorrow, doctor Benjamin Chavis may find out if he'll get his job back. Chavis says he was under contract and he believes the NAACP should honor it. But a judge will make the final decision. Doctor Benjamin Chavis came out of his leadership summit meeting tonight, ready for a showdown in a Washington, D.C., courtroom tomorrow. How are you feeling, Ben? I feel like. Be confident about tomorrow. Yes, sir. Think you're going to win the lawsuit? Jarvis claims the NAACP violated its own constitution when he was fired Saturday. A spokesman says Chavis was treated unfairly. Yes. The organization's lawyers say restoring him to office would hurt fundraising efforts. That was a vote of about 53 to 5 to remove him and to have a court date reversed that, would really be, disastrous, but the enemy could pay. NAACP lawyers claimed Chavis termination did not violate his rights or the terms of his contract, even though it had more than a year left. The board felt that they had sufficient facts to render the decision that it did. They they acted on an educated and informed basis. Benjamin Chavis may now be at the crossroads of his life and career. But despite the uncertainty, and although it seems unlikely he's not ruling out a return to the NAACP, he is a man like all of us. He has his, weaknesses. He's not perfect. None of us are. Meanwhile, the spokesman for Charvis says his future is also uncertain. What we are doing is taking a new initiative to foster unity in our community. What we are doing is taking an initiative to promote a kind of momentum of inclusion within our community, where we focus on the critical life and death issues that impact the quality of life of our community. That is what we are doing. Chavis also promised a youth summit next year, where young people will come together to voice their concerns and hopes for the future. The battle over blood samples in the OJ Simpson case continued in a Los Angeles court today. Simpson's attorneys attacked the reliability of the DNA evidence suggesting police may have bungled blood collections, mislabeled the sample and assigned inexperienced technicians to the case. This, following the prosecution's disclosure yesterday that Simpson's blood has the same genetic makeup as blood found at the scene of his ex-wife's and her friend Ronald Goldman's murders. Our reward for information leading to an arrest. If current enrollment figures are correct, the city school system now owes the state of Maryland over $4 million. Officials say the city unintentionally overstated its enrollment by some 1200 students. Since the state of Maryland bases its school funding on the number of students. The city must make up the difference. A new computer system is being blamed for the mistake. Earlier this year, Paterson High School was very close to a state takeover. Right now, the takeover is on hold. But to keep it that way, Paterson must prove it can do a better job. The principal finishes up the last of three area meetings with students and parents. The charismatic Bonnie Erickson is not shy in expressing what is and needs to be done. And I would like and my staff would like to spend time on what we know best. And that's teaching children, developing programs and guiding them so that they can come out of there and do what they need to do get a job, continue their schooling, be good citizens. That's what we want to do this year. She says these changes are going to be made. Half of the staff is new. They're going to be attendance monitors. The building will be cleaner and safer. The curriculum will be revamped and the staff, not the students, will be in charge. To the parents, it's just what they want to hear. Seems they've taken some of the best ideas from other school systems throughout the country. They're going to try to incorporate them here in the fall tomorrow. With the state breathing down her neck. Does she feel the pressure? Absolutely. I'd be lying if I said I wasn't, but a lot of us in the school system are used to working under pressure. I'm not here to say everything will be perfect. We're going to have some rough spots. We're going to have some warts. Family members are back in court reliving the brutal murder of their loved one. Three years ago, 22 year old Gina Cortez was stabbed to death at her Towson office. A year later, Robert Lipinski was tried, convicted of first degree murder and sentenced to life in prison. But Lipinski was back in court today because a change in law blurred the distinction between first and second degree murder. For the courthouse family, this retrial has opened some very painful old wounds. The whole situation that you started. You start fiction in your mind. Murder. How it happened. What happened? In encouraging news regarding the condition of racecar driver Ernie Irvin late this afternoon, doctors gave their most hopeful report to date. Irvin has been in critical condition since his accident at the Michigan Speedway this past Saturday. Doctors still have him on a ventilator, but progress has been made. He is moving all of his extremities. He is grimacing, moving his facial muscles, and does direct his attention, apparently toward the speaker. That, is for his wife and his family. For me personally, tremendously gratifying. That is just terrific news. Irvine's race team will have an announcement tomorrow regarding how they plan to proceed for the rest of the NASCAR season.
