Ashby is charged with the deaths of 20 people after his jet sliced through a ski lift cable in the Italian Alps. David Martin reports. The fate of Captain Richard Ashby is now in the hands of eight Marine officers who are serving as the jury, which will decide whether he should go to jail for the tragic accident which killed 20 skiers in the Italian Alps. In closing arguments, the prosecution said Ashby was outright dangerous, flying too low and too fast when his jets severed the cable on the gondola and sent the 20 skiers plunging to their deaths. Ashby had been issued and he had not been given the proper speed and altitude restrictions before he began his flight. You can't avoid what you can't see. Ashby's attorney told the jury this was an accident waiting to happen. Ashby's navigator, Captain Joseph Schweitzer, is still awaiting trial. But during closing arguments, the prosecutor said Schweitzer wasn't responsible for what happened. Only Ashby Schweitzer's lawyers immediately called for a dismissal of charges against him. The evidence presented throughout this entire trial has demonstrated what we have maintained all along. The Captain Schweitzer acted professionally in his planning and briefing of the flight. The jurors deliberated for hours yesterday and are set to resume this morning. If Ashby is found guilty of involuntary manslaughter, he could receive a maximum sentence of 200 years, ten years for each of the 20 skiers who died. David Martin, CBS News, the Pentagon. Each year, about 20 million American smokers try to quit, but only 6% of those are able to stop over the long term. A study in this morning's New England Journal of Medicine compared Zyban, a prescription medicine that helps ease the symptoms of withdrawal with the nicotine patch. Researchers at the University of Wisconsin had a group of smokers either take a placebo, take Zyban, use the patch or use both the patch enzyme and for nine weeks after one year. And as we told you this weekend, she was killed when her car was hit head on by an ambulance, its brakes locked up in the rain. This morning, family and friends packed this church in south Baltimore to say goodbye to the young mother. Fleet was only 34 years old and she leaves behind a 14 year old daughter. Another young woman who left us much too soon will also be remembered today. 18 year old Melissa Pennington, one of the two women killed in the Wawa, hold up Monday night. Many gathered in Aberdeen last night to remember 31 year old Nancy Atkinson and 18 year old Melissa Pennington, who were both killed. Stacey Rushing pleaded guilty to two counts of reckless endangerment in the accidental deaths of two five month olds at her Stephenville daycare home last May. Ian Denny and Matthew Harrison both suffocated while taking a nap. Prosecutors today agreed to drop the manslaughter charges against Rossum. She still faces ten years in prison when sentenced next month. Starting today, Jay Z 13 officially begins shaving tomorrow. And here's what people are talking about tonight. A gas tanker overturns on an onramp to Interstate 95, but that's only part of this breaking story. The tanker spilled most of its fuel load. Where the fuel now is is the big problem. Eyewitness News is live on Sky Chopper 13. Kathy Fowler has more on this breaking story from over the Inner Harbor Cathy. Well, Vic, earlier tonight, it was a fear of explosion. Tonight, it's a fear of a different kind. We've just learned that the entire 8900 gallons in the tanker is spilled. Now, what we're looking at right now is South Hanover Street and McComas. There's still large puddles of gasoline under the I-95 south onramp. And what's worse is a lot of the fuel has leaked through storm drains and is now in the harbor. Cleanup crews are now using boom booms to fight devices that tie together, forming a perimeter around the camera, the spill in the harbor. What they're trying to do is contain the spill and keep it from spreading to the rest of the harbor. I thought it was going to explode and we weren't going to be living any more. Me and my family. Brian Morgan said he was following this huge tanker tonight on the 95 south on ramp when all of a sudden something went very wrong. It was turning around at a fast speed on the ramp there and the back to wheels turned over and made the whole truck go with it. Eyewitnesses say the tanker slammed into the guardrail, tearing a hole into the concrete. It flipped and slid a little. And you can see the gasoline or whatever it was leaking out. And now it's running out like a river, just running down the ramp. Fire officials say the entire 8900 gallons of gasoline spilled onto the highway into the storm drains. And we just found out much of it in the harbor. What are eyewitness news cameras can't show you is the strong odor of gas fumes that have affected people blocks away from the accident scene. We had reports from Light Street where people have complained about heavy odors of gasoline in their basements. Neighbors were evacuated, streets were closed and trains diverted. One man who lit up a cigaret had police and firefighters racing towards him. Officials fearing any spark could set off an explosion late tonight. Now, if you live in South Baltimore and you're smelling that strong odor, they say open your window and call the fire department back. Well, can't of cause. We're also concerned about the what we're concerned about the environment, also concerned about the residual effect and the possible effects on traffic tomorrow. What do you know about that? Well, traffic tie ups tonight were a mess. And the fear is that it could be the same tomorrow. Southbound of our street is still closed tonight. Well, according to residents out here in Arbutus, you do the best you can. Candles, lighters and something to snack on. Got them by. And I had plenty of candles. And we have a gas range. So we were fine. So you can still cook? Yeah. Yeah. So had dinner. Well, this is what our neighbors around the area had for breakfast. A plate full of snow and a tall glass of wind. In some cases, even a few accidents. It's crazy. Starting last night. This first time I haven't seen rain, thunderstorm and in snow all in the same night. And of course, that was Chi Jackson reporting. Coming up a little later in this newscast, I was news. We'll take you to western Maryland where residents there are still digging out from up to two feet of snow and drifts twice that high. That's coming up in about 12 minutes. Four teenagers and one adult await their fate for murdering a pig town barmaid. One year ago, Terri Ambrose was gunned down while tending bar. Today, the 15 year old trigger girl and her four co-defendants plead guilty to the crime. Prosecutors had a videotape of the robbery. Ambrose's family told Eyewitness News, while they're glad it's over, the pain of their loss still is being felt. The defendants will be sentenced in May. An Eastern Shore woman faces up to ten years in prison for her part in the deaths of two babies in her care. Stacey Rossum entered an Alford plea to charges of reckless endangerment. The plea means that Rossum did not admit guilt, but agreed prosecutors may have enough evidence to convict her. Two five year old suffocated while taking a nap at her Stevensville home. Rossum will be sentenced in May. If you enjoy talking on your cell phone while driving, you'll be happy to hear this. A state bill that would have kept you from using your cell phone while driving did not survive a committee vote, but it had passed. Where they had it passed, you could have been fined $500 on a misdemeanor charge. Time now to check in with John Bureau and he's back on Sportscenter. Hey, a lot of basketball coming up tonight. Eyewitness News has learned that a man in custody for allegedly shooting a Prince George's County police officer gave police information about the Starbucks shooting and identified two other accomplices. As you remember, two of the victims in the 1997 coffee shop murders were from Baltimore. A military Marine captain learned his fate for his part in a tragic accident. Richard Ashby was flying the jet that sliced into an Italian ski lift last year, sending 20 people plunging to their deaths. Ashby was found innocent of all charges, but he still faces a separate trial for obstruction of justice. As you can probably understand, the families of the victims are stunned by this verdict. Tonight, a story about Eyewitness News change a man's life for the better. Seven weeks ago, Barry Walker was a heroin addict, homeless after his mother threw him out. That changed after he was interviewed on Eyewitness News after his friend, another homeless man, had died. The shock of that death sent Barry into detox and on the road to a new and better life. Then he mentioned thank God. And I really thank Channel 13 for you guys sitting there for me in the first place. I probably would still be there because nobody would have seen me. Barry is now living with his cousins who sought him out after seeing him on Eyewitness News. As we told you earlier, snow hit western Maryland pretty hard today. Alex, to me, two reports from Garrett County where more than a foot of snow fell. Vicki, If it wasn't a blizzard that hit Garrett County, it was certainly the next best thing. It started last night and roared on most of the day. It's not for people. It's about like the North Pole that way. And it just it just cut you. The heaviest snowfall came along the ridge lines. How much is hard to say because strong winds kept moving it around. Piling it up in drifts as deep as five feet. You can't kind of figure out how much is flowing here because we got too much wind. But I think we've I would say we're in the neighborhood of 12, 15in here. Blowing snow had plows going over the same stretch of road more than once. It wasn't until this afternoon that things started to improve, If you can call this an improvement since late last night, it's been miserable. The wind visibility was zero all night long. We've had separate block for a good portion of this morning, this stretch of Interstate 68 between La ville below US and West Virginia, somewhere above us up here, it was closed to all traffic because of blowing wind and whiteout conditions. And those white outs and high winds played havoc with truckers. Along Interstate 68, trucks slipped and flipped at many of the higher passes. For those who didn't have to hit the road, there was still plenty of digging out to do. This is one of the heaviest we've had quite some time. About the only people who got a break today were the kids. Snow shut down all the Garrett County School and all of this snow is actually a welcome sight. It's been very dry in western Maryland this past year. Cumberland 36, Richmond, 34, Ocean City in Salisbury, freezing in Dover, 30 right here in Tree Hill. Areas north and west still have some snow cover. That's where the temperatures are really going to fall tonight because of that snow cover. Didn't get a lot of heat absorbed today. 42, 31, 5031. Your average record, 79 and 13 on this date. The big storm still causing problems in Rochester, New York. A state of emergency, a record 24 hours snowfall, almost 25in of snow. The town is really shut down. And even Rochester, that's a lot of snow for them. That's amazing. It's now dwindling down. Just some flurries, but we've got clear skies now to our west. However, a new system will cause some lighter precipitation here tomorrow night, very, very late, probably Saturday morning. And it may be cold enough at the beginning or we might see just a little bit of wet snow Saturday morning before it changes to some rain as some milder air comes in. You can already see the clouds out to the west. For a while tomorrow we'll see sunshine and then the clouds start rolling in from the west. This is not nearly as strong a system as the one that just went through. But we do expect to see some rain in some windy conditions setting up Saturday afternoon. And Kathy Fowler has more on a fatal fire in Crofton Kathy. Well, we've just learned from an L.A. County fire officials that one person has died in a house fire near Crawford. And now Sky Chopper 13 is flying over 2546 Harbor Court, where firefighters earlier we reported that they had just knocked down the fire. You can see that there's smoke is still pouring out of the house and there's still some flames right there in the in the corner of the screen that you could see that the fire is not quite out. We've been told that the fire started around 10:00 at this ranch story house and it quickly escalated to a three alarm fire. Firefighters are still trying to control the fire.
