What police first thought was an accidental killing nine months ago has now been ruled a case of murder handed down from the county. 12 year olds been charged with murder in the second degree, but it's still a charge he'll face as a juvenile. It was November 24th. 11 year old Nicholas Pastorius, seven, was killed by a shotgun blast to his chest at the home of a friend. After his death was ruled accidental. But after months of investigation, the county state's attorney's office now says the shooting appears to have been intentional after all. Last Monday, the 12 year old was officially charged on a juvenile citation and released into the custody of his father. Benjamin Garrett will learn his fate later today in Baltimore County Circuit Court. The 16 year old was convicted of first degree murder in May for the death of his counselor at Sheppard Pratt Hospital. Sharon Edwards was stabbed to death in Harris's cottage at the hospital. He escaped after the murder and eluded police for several weeks before he and a friend were arrested in Virginia Beach. Garrett faces the possibility of life in prison without parole. This wasn't a great weekend for flying both here out in the Midwest and over in England, where an antique fighter plane crashed, killing its pilot. The P-38 Lightning was part of a Flying Legends air show at a combination airport and museum northwest of London. The World War two plane spiraled onto the runway and burst into flame while performing a low level pass by. No one else was hurt. None of the passengers aboard a United Airlines jetliner was hurt when it was forced to make an emergency landing in Wichita yesterday. The 757 was en route from Miami to Denver when noises started coming out of one of the engines. And the plane shuddered suddenly. The next thing passengers knew they were touching down in Kansas. There were a couple of booms and pops, and then I could just tell we were starting to go down and we weren't close to Denver yet. So and we didn't hear anything from the pilot for a while. So we weren't nervous. And then when we got down, we saw the fire trucks and the police. It was like a little scary. It turns out a compressor in the jet engine stalled and it just quit. The passengers deplaned safely and continue their journey on a different plane here. And ultralight aircraft crashed in Carroll County on Saturday night, killing its pilot. Stormy weather across Maryland last night caused two separate incidents in Harford County. A man attending a concert at LeDoux Topiary Gardens on Jarrett's Bill Pike was struck by lightning. The identified victim was taken to an area hospital for treatment and released. Lightning was also to blame for a house fire that sent an off duty sheriff's deputy to the hospital. The two alarm blaze happened at a home on Norris Northville Road and Coen Drive. The injured deputy was treated for smoke inhalation. No word yet on his condition. Bartlett's gone, and now most of the resorts along North Carolina's beaches are open once again. The hurricane did leave behind quite a bit of damage, though. Red Cross says early estimates show nearly 58,000 homes took a beating and about 200 were destroyed. Some evacuees still haven't been able to return home. Nobody will tell me when I can get back on. And if my house is there, if I own anything anymore and nobody will tell me a word about anything. As Bertha traveled further east as a tropical storm, she battered New York, uprooting trees, damaging cars and homes in the area. The storm also made its way up to Canada, but by then it had lost much of its strength. Well, the weather is as bad as it was here this weekend. Kathleen Koch reports. Air traffic controllers are worried. It is supposed to make the sky safer. New terminal Doppler weather radar installed by the Federal Aviation Administration near 16 airports. When it's working, it gives advanced warning of the sudden downward thrust of air known as wind shear and its more deadly counterpart microburst. But individual airports, records and data collected by the National Air Traffic Controllers Association show the radar isn't completely reliable. The big problem right now with it is we can't we can't keep it running. At National Airport, it's been going down since it's been installed. I don't think it's gone seven days in a row without a failure. And in some places, it's gone. It's failing 2 or 3 times a week. The FAA describes the new radar as an enhancement to existing wind shear detectors, adding it works 95% of the time. And this is a very common stage that a new system will go through in which you find the final bugs and work them out. The FAA says outages are worst at airports in Kansas City, Houston, Dallas, Denver and Washington, DC national airports. Doppler radar in that city was down during a violent storm last month when a U.S. air shuttle was hit by wind shear on takeoff and one wingtip struck a runway light. The FAA says many of the outages are associated with a computer at the radar site. They also blame some of the shutdowns on faulty phone line connections between the radar and the control tower. FAA engineers are working with Raytheon, which makes the radar system and other contractors to solve the problems. The battle between discount retail stores in Maryland will soon begin. And Target is at the center. The Minneapolis based discount chain will have 12 new stores throughout the state come November. Several stores will also be opening in Virginia. This target invasion is good news for thousands of people who will get jobs because of the expansion. But bad news for its likely competitors, Wal-Mart and Kmart. And it must have been some kind of a crab feast. Harvard County sheriff's deputies are looking for the robbers who hit a job, a seafood store, earlier this month. The deputies say the robbers made off with 23 bushels of crabs, 300 pounds of crab seasoning and 150 cases of beer from island seafood. The sheriff's office isn't optimistic about finding the culprits. Deputies say the evidence is probably long gone since the robbers also stole crab pots, steamers and tools he's charged. This does put up a worry that having Harvard County just put up a roadblock, start checking everybody's fingernails. Yeah, that's a good. You guys see that many bushels of crabs and you're never going to get them big boys going, right? Plus, we had a lot of rain and all of that moisture is trying to evaporate. It's just very, very steamy. This is a pretty zesty front coming through the area. It's a wind shift. He's got dry air. What you can't say. A cold front today. We're going to call it 88 as a high. Tomorrow we're calling it 90 as a high. So we're not talking about a cold front, but we are, no question, talking about noticeably dry air, we may lose 57% of this humidity and that'll be just fine. And you'll start to feel it later on this evening, definitely overnight and tomorrow, as this cleaner air, if you will, makes its way into the air. Now we're starting to see some light shower activity in the region, a few thunderstorms here and there. But once again, without this real thermal kick, we might not see any heavy severe weather in the area. That remains to be seen as the afternoon goes on. Police and British soldiers patrolling the streets are dodging rocks and gasoline bombs thrown by Catholic nationalists. The latest blow to peace came over the weekend when a car bomb exploded outside a country hotel. No one was injured in the blast. The IRA denied responsibility. Two people were killed in a tragic crash in an Indy car race in Toronto yesterday. The race was almost over when a car driven by 31 year old Geoff crossed off, rushed another car and went flying into the air, then hit a retaining wall and burst into pieces. One of the pieces smashed into a safety worker standing behind the barrier there. An indication today of just how desperate drug addicts can be to get a powerful high. Last week, a musician with the rock group Smashing Pumpkins died of a heroin overdose. Now, New York police say addicts are scrambling to buy that brand of heroin that killed him. They reportedly think it will give them a more powerful high. Anyone who goes by the street name of red rum, which is murder spelled backwards. Kathie Lee Gifford takes her high profile battle against child labor to Capitol Hill today. Gifford started the campaign after revelations her Wal-Mart clothing line was partially made by underpaid underage workers. Gifford denied any knowledge about the matter. Today, Gifford's testifying before a congressional committee investigating child labor and sweatshops. The International Labor Organization says 73 million children age 10 to 14 are in the workforce. And today's Noon Health Watch, 1.5 million people suffer from heart attacks every year. But now researchers say they're narrowing the search for the things that trigger the attack. Sex, angry outburst and strenuous activities have been identified as triggers for about 17% of all heart attacks. Researchers say that they've recently discovered emotional stress caused by panic or fear may be another important trigger to watch out for. More studies are now underway to figure out what other things can cause heart attacks. Also in health, watch, a new drug to treat women in the advanced stages of breast cancer is on the horizon. Researchers at Clemson University are testing the magic bullet theory. It's a drug that attaches to cancer cells and kills them so that they cannot multiply. Good evening, everyone. 16 year old Benjamin Garris will spend the rest of his life in prison for murdering his councilor, Sharon Edwards. There is no possibility of parole. Alex Demetrius is standing by live at the courthouse in Charleston where the sentencing hearing has just ended Alex. Well, sadly, 16 year old Benjamin Garris is really only at the beginning of his life, and tonight he knows exactly where his life will end. Somewhere in prison for what he have for what Benjamin Garris did to Sharon Edwards. He will now spend every day of the rest of his life behind bars. The lives of Benjamin Garris, Sharon Edwards intersected at this residential cottage at Sheppard Pratt Hospital last October. It was Edward's first night on the job as a live in counselor, 26 years old, the mother of a young child. She was brutally stabbed to death by 16 year old Benjamin Garris. Garris also tried to burn down the cottage where two other patients were sleeping before running to Virginia Beach with 15 year old Jane D'Costa. His capture in Virginia led to a trial this past spring and a conviction of first degree premeditated murder. In large part, Garrett's own words condemned him. In a confession that detailed the murder, including Edwards begging for her life when she wouldn't die fast enough, Garris called it aggravating. He did, however, ask the judge to keep parole open as a possibility, saying that someday Mr. Garris may be cured of his mental problems and that he could become a productive member of society. The judge evidently did not agree. Sally. Alex, did Benjamin Garris say anything in court? No, he did not say a single word. He had that opportunity. Instead, he apparently wrote a short letter to the judge instead, and the his attorney stood up and explained why he did not allocute or speak for himself before the judge, who said that his client did not wish to cause the Edward's any more hurt. Eight months ago, police called it an accidental death. Tonight, the death of 11 year old Nikki. Her story has been ruled murder. There was no one home today when I knocked on the suspect's family's front door. It was just a bad matter of bad timing. I think that the two boys happened to be in the house at the same time. Place Oak Ridge. Two Hartford County teens die in a car crash this weekend. 17 year old James Weston of Jacksonville was driving his 1990 Subaru on Northville Road near Old York Road in Whitehall. It was worn on Sunday morning when he lost control of his car, rounding a curve. He's sliding sideways and there is a concrete abutment by the pole that he hit and flipped his car into the telephone pole and broke the pole. 17 year old Dru Scott was a passenger in the car and was also killed. Both were graduates of North Hartford County High. Police continue to investigate the accident. The next thing James knows, he's hit in the head with an umbrella. The girl, Tom Breland, banned from umbrella. My man called me. He said, Yo, watch out. Then the guy just started jumping on the stage, started coming from nowhere, and next thing I know, which is people just swoon all around. During this confrontation, approximately 10 to 15 males from the neighborhood joined in the confrontation during which time the 25 year old victim was stabbed several times in the back. She tried to stab me and I stepped to the side and it hit me right here. If one from the middle of my face already, I got stitches inside and out while the mob beat them both. The woman went after Antonio. It was one girl. I was the one stand. I seen a stab wound. She was right there. Just weren't swinging. Just swinging. And she knew she had a knife. At the time, James looked worse off. He didn't know that Antonio took three deep cuts to his back. By least I did. I did get to say, you know, that I loved him. He got to say that he loved me and it didn't. That I did what I could. He'd done. But I made it home. Health Watch reporter Kelly Allen has news about a promising new drug treatment. Yes, it is a treatment being developed by researchers at Clemson University. The treatment is based on the magic bullet theory. Doctors say the best defense against breast cancer is still early detection, primarily through breast exams. But they're finding out when cancer does grow. A combination of drugs seem to work. The magic bullet zeroes in on the estrogen receptors that allow the cancer cells to multiply. Within preliminary studies in cell cultures, we've taken human breast cancer cells and cultivated them in the laboratory and with shewn we can destroy them very low concentration of our drug. If the therapy holds up under further research, it could change the usually dim prognosis for women with advanced breast cancer. But this doesn't apply to everybody who's been diagnosed with breast cancer. No, not at all. This is estimated to help about 40% of patients with advanced breast cancer. Still very promising. Yes. Turning to other developments tonight, Central Mexico, the scene of a deadly accident today as a bus plummeted down a 25 foot embankment. 17 people were killed, 20 more injured after this terrible accident. The bus was seen speeding when the driver lost control. Scene of the crash 100 miles west of Mexico City. At least 26 people are dead after a cargo plane carrying members of a Dutch military band crashed just a few hours ago. Lightning was also to blame for a two alarm house fire that sent an off duty sheriff's deputy to the hospital. The blaze happened at Northville Road and Coen Drive. The injured deputy was treated for smoke inhalation and also released. Maryland got off easy as Hurricane Bertha swept up the East Coast. But Rob says people in North Carolina will be mopping up for quite some time, although don't tell that to people in Ocean City because they got a wallop as well. But in some coastal resorts, people didn't even get back to their homes until the day Firefighters in Surf City, North Carolina, took this video as they tried to rescue people caught in the middle of a storm. Bertha dumped tons of sand on roads and people's houses. Property damage is estimated at $60 million and business owners say they lost about $24 million because of tourist dollars lost to the storm. So a real mess down there in our local area. Some showers and some thunderstorms, some heavy ones on the eastern shore right now. But right now, not much happening. A couple of things out to our west. You can see them moving through the area during the afternoon hours. And yes, there's still a risk of some more showers yet this evening. A city cab driver faces charges tonight after driving head on into a house. Police say the cab was going westbound on Lafayette and ran a stop sign at Wall Street. It had a 1998 Chevy Cavalier then slammed into the house. The cab driver, his passenger and the driver of the Chevy all went to the hospital. The cab driver is charged with failing to stop at a stop sign and speeding. Well, Mondays are tough enough for us all, but don't tell me we have traffic types to talk about tonight. We helped carry them over to where we could start getting everybody together for medical treatment. Shane's family welcomed him home today with big smiles and a big banner. His mother is wearing a necklace he brought from Saudi Arabia. Shane Little will soon return to Shaw Air Force Base in Sumter, South Carolina. But for the next week, he is home here in Hancock with his family. I feel relieved. And one man was killed last night, another severely beaten as they stood at a bus stop in Greenmount and North Avenues. James Troy's as a mob of men jumped on him and beat him while a woman stabbed his friend Antonio Coakley to death. And witnesses to the attack are asked to please call Baltimore City police. Now the story of a Florida mother facing charges tonight for what appears to be the drowning of her three year old son. Judy Williams has been charged with child abuse in the death of her son. The county sheriff says the death appears to be from drowning. Neighbors are still shocked at what happened in this house. Williams was supposed to make her first court appearance today, but a public defender stood in her place. Well, it's a hard case to crack, but Harvard County detectives are sticking their teeth in it anyway. Someone stole a load of live crabs from a job at town seafood store. And as Pat Warren reports, it's no picnic for the owner. Is enough crabs, crab seasoning to have a pretty huge party or start a small business at the expense of his own. Steve Bates operates island seafood in Japantown, but on the 4th of July weekend, he found himself with nothing to sell 20 bushels of crabs, 300 pounds of crab seasoning, and nearly 200 cases of beer were stolen from his storage sheds by professionals or party animals.
