Good evening everybody. Gabriel. Kirsten is a lucky man. We have team coverage of his dramatic ordeal, beginning with Melissa Sander, who talked with him as he was released from Shock Trauma. I thought maybe I wasn't going to get out. I thought maybe I wasn't going to have a leg. I thought a lot of things, but I feel okay. I feel lucky that I'm so healthy. A triumphant Gabriel Kerrison is wheeled out of shock trauma, smiling despite the pain in his right leg. I was hurting like hell on my leg because I got my leg caught on a on a corner. Of the foundation. For six hours, the 21 year old construction worker was stuck in dirt up to his waist alongside the house he was waterproofing. Kerrison was about to join his coworkers for lunch break. Just as I turned around to walk. Walk away, I saw it falling and to get out. That's all fine. And then it all came in. Pearson's firm, Beechwood Design Builders of Columbia, won't comment as motion investigates. Doctors at Shock Trauma say Gabe Pearson is lucky nothing's broken down. His right leg didn't swell to the point of causing muscle damage. It's just soreness. Just battered and bruised and battered. He should be walking without crutches in a week. Melissa Sander, channel 13, Eyewitness News. It could take up to a month for most Maryland occupational safety and health to wrap up its investigation. One of the reasons Gabriel Carson is alive to talk about his ordeal is a teacher turned Howard County medic. Ron Matz continues our team coverage with the young woman who helped save a life. That was the sound that started Karen Beth Ross's Long Day's Journey Into night. The 34 year old Howard County medic was first to administer Gabe Pearson aid at the scene of the cave in. She stayed with him for six hours. She tried to take his mind off the situation he found himself in. Six hours is a long time and a lot of space in between and everything that went on. I explained to him what was going on, so that helped take up some of the time and his mind and got his mind off of things. It's just like with my students, you have to connect with them in order to get across the point you need to get across. In order to educate them, you have to connect. And that's what I feel Gabe and I did. We connected yesterday. A connection that helped save a life and make a very long day. A triumphant one. Very exhilarating. I feel really good about helping Gabe yesterday, and, it's a neat feeling. Ron Mattes, channel 13, Eyewitness News. Howard County medics work an unusual shift there on 24 consecutive hours and then have 48 hours off. The question of safety always arises after an accident like this one. State investigators say it didn't appear any trenching safety rules were followed at another site in Howard County. We were shown the right way to Shore Trench. The law requires at any time a trench is deeper than three feet. It must be supported with side walls, have sloping sides, or workers must use a trench box. There's just some contractors that think, well, if I cut the trench in here and the earth stands up, it won't fall down. And those are the kind of people end up. They go in the trench, it falls and fails and people get hurt and injured. There have been 11 deaths in trenches since 1985, in Maryland. City Council President Mary Pat Clark and Maryland State Attorney General Joseph Curran were featured speakers. Occupational safety and health reform legislation was the focus of the noontime rally. One of the six people injured in yesterday's house fire in Essex has died of her injuries. 36 year old Joyce Pursell passed away at the Bayview Burn Center. Doctors say she suffered third degree burns over 85% of her body. The survivors do not have Life-Threatening injuries. Investigators say the blaze may have been deliberately set after spending 21 years behind bars. A convicted killer gets another chance at life. In 1973, William Billy Isaacs went to prison for his part in a crime spree that claimed seven lives. Today, he walked out of Brock Bridge Prison in Jessup wearing jeans, a blue t shirt and dark glasses, holding the hand of his fiancée. Isaacs says all he wants to do now is enjoy life. A newly formed victims rights group is giving loved ones of murder victims a voice. Survivors Against Violence Everywhere is holding a rally downtown. Kai Jackson joins us now live from that rally with more. Hi, Kai. Hi, Sally. How are you? It's a newly formed group. And the group is part of the family bereavement center in the city and states or the state's Attorney's office. And it already appears to be having success. They do appear to be having success with this operation. Francis Patterson, we're going to show you some video now, Frances Patterson and her daughters are the survivors of Robert Bradley Baker. He was tragically shot and killed in September of 1992 as he tried to break up a dispute. Now, his family says it's groups like say that help the survivors cope with the pain and loss of a loved one. It does help if you go to these programs because we are trying to reach people and we're also working with, say, to go throughout the city to different charities or social events where they are teenagers and adults. Now that the family has been helped by the group, say they're also trying to work with others who have experienced the loss of a loved one. And again, this is a very difficult situation for a lot of people. So this is something they're working on right now and they should be out here probably in about another 25. It's Sally. We understand a good contingent of those who are victims or survivors of those who are victims. Sally, do you know any other projects that the group save is working on? Well, one of the one of the major thrust right now, Sally, is trying to work on the Victims Rights Amendment. The Baltimore Sun's 37th annual Police Officer of the year banquet awarded two men for outstanding community service and law enforcement officers. Brendon Gable and Frederick Carter were not only honored, they were each given checks for $1,000. Congratulations to both of them. Let's take a look now at some of the other stories making headlines. This Thursday, April the 28th, Mayor Schmoke endorsed Paris Glenn Denning's gubernatorial campaign today. The Prince George's County Democrat says the prosperity of Baltimore is the hope of the entire state. An ad Arundel County jury found a teacher not guilty of having a sexual relationship with one of his students in 1976. Thomas Newman says he doesn't even remember the woman, and the defense rests in the trial of doctor Jack Kevorkian. Kevorkian is charged with violating Michigan's ban on assisted suicide. He faces four years in jail and a $2,000 fine if convicted. Massive layoffs are coming to Delta Airlines, the nation's third largest carrier, plans to eliminate 15,000 jobs about 20% of its workforce, over the next three years. It's going to be a war because prominent leaders in the community met in Little Italy today to talk about how to fight government intervention. The war has begun. They formed the Maryland Coalition Against Excessive Government Regulations to battle a federal plan which would limit smoking. The smoking ban proposal will affect more than 6 million factories, restaurants and schools, but area business leaders say it's absurd for them to try and run a business and to police workers all at the same time. Be able to run a business without someone sitting on your shoulder 24 hours a day, and not to have to be a security or police force to enforce unenforceable regulations. We. The hearing is scheduled for May 3rd, be for the Department of Licensing and Regulation. Sally Local. The local businesses will meet with state legislators right now to try to lobby for their rights. It's going to be interesting now if the federal government passes the ban, when would that take effect? So you want to tell us some of the names of these rats before we say goodbye? They're they're pretty cute. Yeah, we name them after every year we pick a theme. In tonight's economy watch boats. The marinas are buzzing with workers in Annapolis as sales soar. Suzanne Collins tells us an industry that's been several years in the doldrums is coming back to life. Frank Dailey is a fiberglass man. Several years ago, he lost his job at a boatyard that laid off three quarters of its workers when the industry slumped. He waited a long time to find a new job. And now this year, orders are lined up. I know the boat sales are picking up, and everybody seems to be. This yard's full of a lot of contractors, you know, right now. So everybody staying busy. We're we're full for the next three months. They are up 30% at Annapolis yacht sales, according to its president. More people will be put to work. More people will be sailing boats. A few years ago, two blows hit the boat business right in the bow. First, the economy slumped and the federal government slapped big boat buyers with a 10% luxury tax. If you purchased this 44 foot sailboat before October of last year, you would have paid $10,000 in a federal luxury tax. And many buyers said even though they had that kind of money, they didn't want to pay that tax, just on principle. They were waiting it out because there were always the rumors going around that it was going to be rescinded, and nobody wanted to be the last one to pay that 10%. The tax was lifted in October and the economy has improved. That's when the boating industry saw a glimmer of light. We've got to see if this is real. It's kind of like walking on thin ice. Well, Mr. Henry was a fantastic person. He worked a full time job, but on the weekends, his time was devoted to the children and to the band. The Curtis Bay Marching Band is just a memory now. Mr. Russell passed away several years ago, but meet Florence Adams. She was one of the original band members also. Okay. And that's Alan, her son. He was taking guitar lessons from Mr. Henry's grandson, Frank. One, two. Ready. Play. Just like the old days. Listen, tell us what Greek Orthodox Easter is. Well, Greek Orthodox Easter is the same as everybody else's Easter. Except that we have to celebrate after the first full moon, after the first vernal equinox. And, that's Monday, right? Yeah. Well, no Sunday. Sunday. The full moon is now. And so, if you've noticed, there is a full moon. And so we always have to wait until the, first full moon after the vernal equinox. And providing the Passover has started, and traditionally, we have the Greek Easter bread that you see here. And you will notice that the ones that are made have a red egg. The, Greek Orthodox dye their eggs red, signifying the blood of Christ that was shed. Now, here I have, the bread in the different stages. I have the dough, I have some of the bread rising. And then I want to show you how I shape the bread. This we take the dough and divided into three strips, and then we shape it into a braid. Some people will shape the braid and oftentimes we'll put instead of putting one red again they will put four red eggs signifying or symbolizing the cross. And when they leave the church, they're given by the priest a red egg. And the greeting then is he stores honesty, which means Christ has risen. Howard County medic Karen Barth was Gabe Carson's emotional lifeline through the ordeal. Go ahead and put it on and you to feel some moisture in it now. Okay. We just talked about little, little petty things and small talk. And then she kept me going and she made sure I was still with it. It got to a point where I was like, well, I'm going to tell you about my boring life now, okay? And he started laughing. He was great. Tell me, tell me. And he just wanted the constant reminder that someone was there just to have somebody there. That was always focusing on me, making sure I was okay because, I mean, everybody is trying to get to me, but having somebody make sure that I was okay was most important right there. Oh, hold up, hold him up. Bring him up a little point. After six hours of digging and hoisting, Carson was free. Nothing broken. No signs of permanent damage. Doctors at Shock Trauma say Gabe Kherson should be off the crutches and walking on his own in a week. Pretty amazing. And due in large part to the quick work of The rescuers, they did a fantastic job. I really thank them a lot. It could take the state a month to complete its investigation into the cave, and the construction company Baseboard Design Builders in Columbia have denied comment to Eyewitness News. Well, even now, state occupational safety inspectors say it appears no precautions were taken to prevent the trench from collapsing. Our team coverage continues with Suzanne Collins, who says contractors are required by law to protect their workers from cave ins. This Ron Can construction employee is 17ft below ground. Two steel trench boxes protect him from being crushed if the dirt walls collapse. A wedge five feet wide, five feet high, weighs about nine tons. When it falls on top of somebody, it either suffocates them, mechanically, asphyxiate them, or crushes them to death. It may look sturdy, experts say, but that doesn't mean it won't collapse. Simple soil tests must be done to find out what level of protection is needed. The sad thing about it the cost twice as much to do it the right way as it does to take the shortcuts. But you know what's the price of a life? Trench boxes, some call them coffins, are one choice. Contractors have to protect their workers. We're in a box. And if it caves in around us, that's fine. We can get out. But trench boxes can cost 4 to $6000 each. So smaller contractors might shore up dirt walls with lumber instead. Regulations are very specific about how sturdy those walls must be. Fines for willful violations start at $5,000 and go up to $70,000. There is a financial risk for companies who don't use trench boxes like this or other precautions. If you put a man in a trench and he's injured or killed, you've got to live with that the rest of your life. Since November of 1985, 11 people have died in Maryland, crushed in a trench. Most does spot checks at job sites, and when police and firefighters see trenching violations, they are also notifying state inspectors. One of the victims of yesterday's house fire in Essex has died, and that could mean murder charges for whomever sent the blaze. Baltimore County fire investigators say the fire may have been set this afternoon. 36 year old Joyce Pursell died from her burns. 70 year old Virginia Gladden is in critical condition. Two others suffered second degree burns, and a seven year old girl and 38 year old man were treated for minor injuries. When Isaacs was 15, he and a half brother, his brother and another man took part in the seven murders. Six members of a Georgia family were the victims. The seventh victim was in Maryland. Isaacs had 40 years left on his 60 year sentence, but he'll spend that time free on parole in Baltimore City. There are many families that have been torn apart by crime, and some of those families have united into a group and they called themselves Save or Survivors Against Violence everywhere. Tonight that group is holding a rally, and that's where Kai Jackson is, and he joins us live. Kai. Right. Denise said. Rally is out here at the corner Mount Royal in North Avenue. About 20 members of the group save survivors against violence. Everywhere you sit around here, they're holding signs denouncing violence. They're also holding pictures of those that they've lost to loved ones. Many of these families that we talk with say too often no one listens to their pain. But now the group Save Survivors Against Violence Everywhere, is giving them a voice. Frances Patterson and her two daughters are a family filled with both joy and pain. Joy in remembering Patterson's son, Robert Bradley Baker. Pain at the thought of his death. I was paying quite a bit because I really loved my son. He was a very active person. He was a fun person. And this is this is his time of year. Baltimore County Police Officers Brendon Gable and Frederick Carter renamed Police officers of the year by the Baltimore Sun. Officer gable was awarded the Excellence in Law Enforcement Award, and Officer Carter was awarded for outstanding community service. They each also received checks of $1,000, a not guilty verdict for an at adult county teacher facing sex charges. Thomas Newman was accused of having sex with a female student twice while he was a teacher at Dunbar High in 1976. Jurors deliberated more than eight hours before finding him not guilty. Just before 5:00 tonight, one jurors had. The allegations were too vague and there just wasn't enough evidence, they say, to convict. It's been such a long road, and I've been totally vindicated here today. And I want to go back to work. I've been out of work for over six months and. I've missed it. I feel like it was. Taken away for the. Obviously for something that I wasn't guilty of doing. This verdict may be an indication of, if nothing more. People are getting sick of hearing about this. The keynote speaker was New York attorney, author and child advocate Andrew Bash. They represent children who have been abused. I represent those same children later on in the continuum when they've attacked others. The connection is indisputable. Anybody who says that robbers and murderers and rapists and arsonists about genetic mutations is an idiot. We make our own monsters. We build our own beasts. Supporters of inmate Linda Glazier set up a table at the conference to try and catch the governor's attention. As we've been reporting, Glazier is serving a life sentence for the murder of her adoptive parents. A murder, she says, followed years of physical and sexual abuse. The governor recently asked the parole board to review her case. Just last week, they denied her parole. She served 18 years already and now won't be eligible again for another five years. Baltimore Mayor Curt Schmoke wants Parris Glendening for governor, and he let everyone know it this afternoon at a huge rally in front of City Hall. It's a little awkward for any mayor of Baltimore to be seen contributing to that power shift. The worry is, will it doom the city every time the legislature meets to carve up money? In the case of one ex Baltimore City police officer, it's been an eternity. Former officer Albert Miskelly has waited two decades to, in his words, set the record straight and to clear his name. Miskelly says his downfall began the day he was taken out of the juvenile division and assigned the murder case of a 16 year old girl. The victim happened to be a member of a prominent Baltimore County family. No one was ever prosecuted for the crime. Well, picture this at 70 years of age, Albert Misskelley says he won't quit until the case is closed. No, I'm not going to give up. This is not a prostitution case with, like, on the block or or a number case. No, this is murder, and this has to be done. Albert Misskelley hasn't been a police officer for 20 years. But he's still on the case. We took a walk recently. One that step back 20 years into his life. It helped him remember the teenage girl found murdered in the woods behind Westport and Mount Winans in 1971. The case, he says, that ultimately cost him his job. How was she killed? And I remember a room number and things. Misskelley says he took his findings about the dead teenager to his superiors. It appears she had been lured into a drug and prostitution ring operating out of the hotel. Suddenly, brick walls were erected. He says there were hints to back off, but even the medical examiner at the time refused to cooperate with him. And I said to him, could you show me the autopsy reports on his case? He says, no. He said, I had orders from captain So-and-so not to show anybody anything. And my answer was to him, was this bad? Says police. So I believe he made a complaint against me but refused to show you the file. Yeah. Didn't show me nothing. Scalise has a tip from one of the maids of the hotel. Finally shed light on how people. A person was brought in and given a lie detector test, and he was told after he got done, they said he couldn't do anything. And then one day, I was sitting down in headquarters, and I heard someone in a room say to a suspect, Misskelley outside thinks you killed this girl, but we don't. Miskelly was taken off the case and assigned to Southwestern Station, where he washed walls like a janitor. They said he had problems at. Our agency, probably 15 people, initially worked on this case. It was coordinated. We utilize the news media. The news media assisted us by putting out and trying to attract people that may have had some, some some contact from from the people because of the way we knew this particular individual was lured out of the house. They took Albert Mccauley's gun and badge, and at the age of 50, city police offered him a reduced pension. Muscala took it. Three days after his pension. I went to a company on Monument Street to drive a truck and I asked a man for a job. He said, look, you're only 50 years old. He said, you're thin skinned. Tell me what you did wrong. I said nothing, I didn't do anything wrong. McCauley has worked a number of odd jobs over the last 20 years as an Arab or a school bus driver. He has driven trucks. Now, 20 years later, Albert Miskelly still keeps his own file on the murder. Still talks occasionally to people who might shed a little light on the crime. The trail is cold, and the murder remains unsolved. But city police spokesman Sam Ringgold says the file is not closed. What does he really want? Well, he wants $1 million. These, suit against the city in a variety. A number of other people and organizations. He wants that aired in court. Misskelley wants to be reinstated to the department, and he wants the girl's murderer brought to justice. Well, he's clearly tenacious. Yes. Now, that is interesting how some city youngsters are getting a real kick out of today's sunny weather. Boys and girls between 7 and 11 years old are playing in the city's first soccer league. Last year, Provident Bank formed a soccer clinic, but there wasn't enough interest to form the league. 1994 quite a different year, with more sponsors and plenty of kids to keep the league kicking through the end of June. Pavement that has given way to become a pothole. Some roads are so bad that the potholes have potholes, and after cars find their way into them, they find their way into the shop for repairs. The question is, who pays? The general rule is that the municipality must use reasonable care in maintaining its streets, but it only has a duty to warn of a defect if it has knowledge of it and a reasonable opportunity to correct it. And that is the problem most drivers have. How in the world do you approve what someone else knew and when they knew it? It can take an awful lot of detective work, but it can pay off. Start with the police. Find out if anyone else reported an accident there. If so, get the report. Most public works departments maintain a log of calls and complaints. Do you see any others for that location? Return to the scene of the damage. You may find neighbors there willing to talk about how many cars got swallowed up by the pothole. You may even want to post a sign in the area advertising for other victims. If they exist, chances are they'll travel the road again and see your plea. But keep in mind that the government is not an insurer of your safety. You still have a duty to keep your eyes open and avoid the hazard if you can. Well, even with prior knowledge, I say, what about sovereign immunity?
